Daniel Penny found not guilty in trial over Jordan Neely’s chokehold death on subway after manslaughter charge dismissed

In connection with Jordan Neely’s death on the New York subway, former Marine Daniel Penny was found not guilty of criminally negligent homicide.

On Monday morning, a Manhattan jury returned the verdict, and the 26-year-old was spotted grinning in court.

Since Neely’s death last year, Penny has only been charged with one count of criminally negligent homicide.

He faced the possibility of a 15-year prison term for second-degree manslaughter.

But on Friday, the same 12-person jury told the court again that it was unable to reach a judgment.

There is no minimum punishment, although he might spend up to four years in prison if found guilty on the lesser offense.
