Arizona Woman Cleared of False Arrest, Identity Verified Without Court Proceedings

DEBARYLIFE – On Monday, a federal court in Arizona issued an order dismissing the case against a lady from the Valley who was wrongfully detained and imprisoned by federal officials.

Penny McCarthy, 66, was supposed to appear in a federal court on Tuesday for an identity hearing, during which she would have to establish that she was not an alleged parole violator in Oklahoma.

According to the U.S. Attorney’s Office’s motion, “the United States does not intend to proceed forward at that hearing, and therefore dismissal of this matter and vacatur of the hearing is in the interest of justice.”

This indicates that we made a mistake and will fix it. McCarthy said to AB15, “And I’m supposed to just lay down and play dead, and I’m not going to do it.”

McCarthy and her family are requesting an explanation for why the system handled things so incorrectly.

Recalling the arrest outside her Phoenix home last month, she added, “You showed up with six Marshals looking like something out of ‘Dog the Bounty Hunter’ coming to my door, threatened to take me twice in my driveway.”

Her tale was initially covered by ABC15 Investigators when she gave copious paperwork proving her identity as Penny McCarthy, despite the federal agents’ insistence that she was actually 70-year-old Carole Anne Rozak.

They now want to ignore this. “They wish to ignore it,” McCarthy remarked.

The federal court documents reveal that Rozak, the woman who the police claim is McCarthy, had a troubled past. However, her offenses and parole violations originate from Oklahoma in the 1990s.

According to the same federal documents, Rozak served time in prison for committing all non-violent crimes—including bank fraud, the interstate transit of stolen property, and making false representations to a financial institution—while he was in three different states.

Rozak’s digital fingerprints first seemed to match, according to the Deputy U.S. Marshal in Oklahoma, but they are currently investigating the situation.

To get more information on this case, ABC15 has asked the U.S. Marshals Service for an on-camera interview.

“What am I in search of? I want to reclaim my life. I want ownership of my DNA. McCarthy declared, “I want my mug shots that they took while I was in possession.”
