Americans to get check up to $401 as part of $4.1m privacy settlement – no bank statement needed to get cash

A multi-million dollar privacy settlement could pay up to $401 to thousands of Americans.

In an ongoing lawsuit alleging that it violated privacy regulations, the tech company ESO Solutions has struck an agreement.

The corporation that provides software solutions for emergency medical services and healthcare organizations is accused of violating the state’s Biometric Information Privacy Act in a class-action lawsuit filed in Illinois.

It claims that ESO gathered fingerprints without getting authorization or adhering to the regulations governing the storage and disposal of such information.

These fingerprints were purportedly “required” by workers for ESO clients who clocked in and out using the tech company’s “timekeeping device” called the ePro Bioclock.

According to the lawsuit, the business did not notify the parties involved in the data collection or implement measures to stop the unauthorized gathering of the data.

ESO has agreed to pay a $4.1 million settlement to resolve the litigation, but it has denied any wrongdoing.

Participants must have scanned their finger for an Illinois ePro BioClock and had data stored on a server owned or leased by ESO Solutions between January 24, 2017, and September 10, 2024.

COMPENSATION

The notice of preliminary clearance states that 6,414 Americans will be eligible for a compensation.

Each of these payments would be equal to about $401.

A second round of checks will be sent to claimants if, following all of these payments, there are still money in the settlement fund.

Depending on the number of claimants and the amount remaining in the fund, class members may then receive cheques for at least $5.

The money will be donated to Illinois Heart Rescue and the Electronic Privacy Information Center if there is insufficient funds for a second round of payouts.

To get the money, no claim form needs to be filled out, but if eligible class members want to exclude themselves or disagree with the terms of the settlement, they will need to take action.

The deadlineClass members have fewer than two weeks to do this, as it is December 2.

Class members who are not included in the settlement may still file a lawsuit against ESO in the future for the same problem.

They will not be compensated under the present deal, nevertheless.
