Beyonce wins legal battle and is allowed to push forward with Blue Ivy Carter trademark after fight over small boutique

The U.S. Sun can exclusively disclose that after a dispute with a Wisconsin clothing business, Beyoncé is now able to register the trademark for her baby Blue Ivy’s name.

After her eldest child, Blue Ivy, was born twelve years ago, superstar Beyonce first attempted to obtain federal regulators to trademark her unusual name.

After applying at the U.S. Patent and Trademark Office, Beyonce’s BGK Trademark Holdings LLC got into a dispute with Veronica Morales, a wedding coordinator.

According to documents, Morales, a Massachusetts resident, had been operating her company under the name Blue Ivy Events since September 2009 and resisted the application.

In 2020, the matter went to a tribunal, where the USPTO dismissed Morales’ allegations, concluding that the two were not sufficiently similar.

Even though Beyonce won her case, her attorneys never pursued it further, and it was ultimately dropped.

In November 2023, she reapplied, but immediately encountered problems when an examiner issued a provisional ruling due to a Winsconsin apparel store using the Blue Ivy trademark.

They said Blue Ivy Carter was too “confusingly similar” to the store, which has been using the logo since 2011, according to documents.

However, The U.S. Sun can reveal that they have been given permission to proceed with the process after contesting the denial.

The examining attorney has since made changes to their application, and on December 31 it was eventually accepted for publishing in The Trademark Official Gazette.

‘CASHING IN’

“Within 30 days of the publication date, any party who believes it will be damaged by the registration of the mark may file a notice of opposition (or extension of time) with the Trademark Trial and Appeal Board,” the paperwork stated.

Beyonce’s attorneys will ultimately receive a Notice of Allowance if no objection is raised.

The family may benefit greatly from the trademarked name as they continue to establish Blue Ivy’s career in show business.

Toys, recreational goods, furniture, and even computer and software products are all covered by the registered trademark.

Beyonce’s legal team contested the earlier decision, claiming that “no reasonable consumer would ever suffer any form of confusion when encountering the Cited Logo, which is used with one small shop in Fish Creek, Wisconsin, an unincorporated community with a population of approximately 997 people.”

In a 2013 interview with Vanity Fair, Beyonce’s husband, Jay-Z, first asserted that he and his wife desired the trademark in order to prevent others from profiting from it.

“You don’t want anybody trying to profit from your baby’s name,” he added, adding that people wanted to create goods based on our child’s name.

“It wasn’t for us to do anything; as you see, we haven’t done anything.”

In addition, the pair owns two pending trademarks for their names and twins, Sir and Rumi, who are both seven years old.

Following in her parent’s footsteps and entering the spotlight, Blue Ivy may be able to make money off of her name if the trademark is accepted.

Asshe performed with her mother during the halftime show of the Baltimore Ravens vs. Houston Texans game in Texas, which has increased the number of times fans have seen Beyonce and Jay-Z’s kid.

The documents from October also stated: “When the mark is used by Applicant to sell goods and provide services affiliated with Ms. Blue Ivy Cater, the public will rightfully perceive the mark as connected to and affiliated with her and her superstar parents, Mr. Carter and Mrs. Carter.”

“She has narrated a New York Times bestselling book (Hair Love),danced and performed on stage around the world, and regularly appears with her parents at various public events, with related social media posts garnering nearly a million likes.”

By contrast, the latest Instagram post from the apparel business had only 21 likes, according to Beyonce’s staff.

“These basic facts make clear that the potential for confusion between the parties simply does not exist,” they continued.

“No reasonable consumer would conclude upon encountering the parties marks that Ms. Blue Ivy Cater was somehow connected to a lovely boutique shop in a small town in rural Wisconsin and that theywere jointly launching a clothing line featuring Ms. Carter.”

They went on to say that her well-known family already owns and runs a conglomerate that deals with fashion, entertainment, and music, which is far more likely to be involved in Blue Ivy’s business ventures.

“She has already ‘worked’ with her family in similar ventures, like her mother s clothing line (IVY PARK), music videos, andconcert performances, as well as her father s songs and music videos,” attorneys claimed.
