Confirmed! No Charges for 10-Year-Old Boy’s Homicide Confession from 2 Years Ago”

DEBARYLIFE – Police in South Texas say that a 10-year-old boy who was being questioned for allegedly threatening to kill a classmate informed them that two years prior, he killed a man without killing him. He cannot, however, be prosecuted for that offense by state law.

During questioning for reportedly threatening to kill a kid on a bus last week, the anonymous boy told school officials in the Nixon-Smiley Consolidated Independent School District that he had shot and killed a guy in 2022. This information was released by the Gonzales County Sheriff’s Office news release.

About an hour east of San Antonio, near Nixon, Texas, on January 18, 2022, 32-year-old Brandon O’Quinn Rasberry was shot and killed. The child provided detectives with first-hand details about this incident.

The announcement indicated that the boy claimed to be visiting his grandfather that day at an RV park a short distance from Rasberry’s residence. He admitted to detectives that he killed Rasberry by entering his RV and taking a weapon from his grandfather’s truck’s glove box.

Though he had observed Rasberry wandering around the RV earlier in the day, the boy informed authorities that he had never encountered Rasberry before.

“The child was also asked if he was mad at Brandon for some reason or if Brandon had ever done anything to him to make him mad, the child stated no,” read the release.

Eventually, cartridge casings from the crime site matched the gun used in Rasberry’s murder, which was discovered by investigators on April 12 at a pawn shop in a nearby town. The release referenced the Texas Penal Code to state that the boy cannot be prosecuted for any involvement in the 2022 homicide because he was under the age of 10 at the time of the crime.

“It’s just tragic to learn that the murder was committed by a 7-year-old and that it was also senseless.” The slain victim’s brother, Jonathan Fojtik, told CBS affiliate KENS that it’s difficult to comprehend. “Love was a characteristic of Brandon. Anybody could have his shirt off.”

Following the threat against his friend, the child was charged, according to the release, and is currently being held in juvenile jail as he awaits a court date.
