Driver Accused in Death of TikTok Star Ali Spice to Enter Plea

Thomas Petry, the man accused of causing the crash that killed TikTok star Ali Spice and two others, is set to enter a plea on Friday. Petry, 55, of Orange City, was driving his pickup truck in the wrong direction on State Road 44 on December 11, 2022, when it collided head-on with an Infiniti Q50, killing three passengers.

Among the victims was Alexandra Dulin, 21, known as Ali Spice, a popular TikTok influencer with nearly a million followers. The other victims were Kyle Jacob Moser, 25, and Ava Fellerman, 20. The driver of the Infiniti, Devin Perkins, 24, who was also charged, will face trial on September 23, but Petry’s plea could alter his trial process.

Petry faces several serious charges, including three counts of vehicular homicide, leaving the scene of a crash, and reckless driving causing bodily injury. Prosecutors have indicated that sentencing guidelines suggest a minimum of 37 years in prison for Petry, though the charges could carry a life sentence. Petry’s attorney, Richard Zaleski, is expected to argue for a reduced sentence due to Petry’s clean criminal record. For more details on this developing case, visit here.

Prosecutors will present their own arguments during sentencing, and Petry’s fate will ultimately be decided by Circuit Judge Dawn Nichols. Petry’s defense will push for a lesser sentence, citing his lack of a prior criminal history. His sentencing will take place at a later date following the plea.

Perkins, who was driving at nearly 100 mph just before the crash, also faces vehicular homicide and reckless driving charges. Though his blood alcohol level was below the legal limit, both men could face life sentences if convicted.
