Gabby Petito family’s lawsuit against Moab cops tossed despite judge siding with her parents on ‘faulty traffic stop’

A judge has dismissed the lawsuit that YouTuber Gabby Petito’s family filed against the Utah police department.

Petito’s parents filed a lawsuit against the Moab Police Department for failing to prevent their daughter, age 21, from reentering the vehicle with her lover, Brian Laundrie, who would later become her killer.

Judge Don Torgerson of the Utah 7th District Court, however, granted the City of Moab’s request to drop the complaint and sent it to a higher court.

The case must now be reviewed by an appeals court to see if the Petito family can provide a strong argument.

The Petitos’ lawyers expressed their surprise at the decision in a statement to The U.S. Sun.

Parker & McConki stated, “The decision today may feel like a setback, but it was not unexpected.”

“We never thought this would be a simple process, and we hope the Utah Supreme Court will respect the original meaning of the Utah Constitution to protect the right to compensation for wrongful death claims in these situations.

“We remain committed to pursuing justice for Gabby and thanks the many people who have continued to support us in that fight.”
