Man Arrested 16 Years After Assault on Elderly Woman at Senior Living Facility

In a major breakthrough, James Aaron Whisenand, 43, was arrested and charged for the 2008 sexual assault of a 61-year-old woman at her senior living facility in San Jose, California. After 16 years of no leads, modern forensic technology helped investigators identify Whisenand as the suspect, bringing long-awaited justice to the victim’s family.

The crime took place on January 6, 2008, when Whisenand, wearing a ski mask, entered the woman’s apartment. Prosecutors reported that he punched her, breaking her nose, and then choked and sexually assaulted her multiple times. The horrific attack haunted the victim until her death from natural causes in 2011. Despite efforts by investigators, no suspect was immediately identified, leaving the case cold for more than a decade.

In 2023, a new lead emerged when Whisenand’s DNA was submitted to the Combined DNA Index System (CODIS) following his conviction for misdemeanor sexual battery. This DNA matched evidence collected from the crime scene in 2008, finally linking him to the brutal attack. At the time of the assault, Whisenand lived just two blocks from the woman’s senior living facility, raising further suspicions about his involvement.

Whisenand was arrested in Indiana on September 9, 2024, after local authorities requested him to register as a sex offender. When he arrived to complete the paperwork, he was met by San Jose detectives who had been working on the case since 2008. He is currently being held without bail and is awaiting extradition to California, where he could face life in prison if convicted.
