Protecting Sex-based Rights! Indiana’s Lawsuit Against DOE’s Title IX Overhaul

INDIANAPOLIS — Attorney General Todd Rokita is suing the United States Department of Education (DOE) for its direct assault on girls’ and women’s rights through a radical revision of the Title IX rule.

The new law allows biological men to enter girls’ and women’s private spaces, such as bathrooms and locker rooms, as part of the Biden administration’s unwavering commitment to advancing the extreme ideology of the far-left transgender movement. “We cannot effectively protect women’s rights — or even their physical safety — if we refuse to acknowledge there are two sexes, male and female ONLY two sexes,” Rokita said in a press release. “We cannot function effectively as a republic if we deny the basic facts of creation.”

The six-state case is being led by Tennessee, Kentucky, Ohio, West Virginia, and Virginia.

Title IX, enacted in 1972, served to equalize women’s access to educational facilities and programs by prohibiting sex-based discrimination in federally financed schools. At the same time, because of the long-standing physical distinctions between men and women, Title IX has always permitted sex-segregated areas, such as toilets and locker rooms, which are common throughout the country.

The new DOE rule, under the pretense of combating “gender identity discrimination,” effectively eliminates sex-based disparities in educational activities and programs. It requires Indiana and other states to accept radical gender ideology in their schools.

DOE has issued the new rule in contravention of Congress’s repeated unwillingness to broaden Title IX’s protections to include non-sexual activities.

Assume the DOE’s unapproved rewriting of Title IX is permitted to stay. In such events, Indiana schools must allow males who identify as female to use girls and women’s restrooms and locker rooms, play on girls’ and women’s sports teams, and participate in other female-only activities and areas. Otherwise, schools might lose billions in federal support.

“Congress intended Title IX to prevent discrimination against girls and women,” Attorney General Rokita explained. “The goal was to enhance girls’ and women’s participation in middle school, high school, and college sports. Leftists are now attempting to distort Title IX to codify the very anti-woman prejudice and discrimination that the statute was intended to address. With this case, we hope to put an end to this tragedy.”
